Terms and Conditions of Art Submissions

1. Introduction
Welcome to The Dope Doula's Art Submission Initiative ("Initiative"). By submitting your artwork ("Submission") to The Dope Doula ("we," "us," "our"), you agree to comply with and be bound by the following Terms and Conditions.
2. Eligibility
- Age Requirement: Participants must be at least 18 years old or the age of majority in their country of residence.
- Global Participation: Open to individuals who use drugs worldwide.
- Exclusions: Employees of The Dope Doula and their immediate families are not eligible to submit artwork. Third parties directly involved in the selection or judgment process (such as future printers or service providers) may still participate, provided they are not in a position to influence the selection process.
3. Submission Guidelines
- Original Work: Submissions must be original works created solely by the participant.
- Format: Artwork must be submitted in high-resolution digital format Hi-Res 4200 x 4800 pixel (wide x tall) 300 ppi transparent .PNG
- Number of Submissions: Each participant may submit up to three (3) pieces of artwork.
- Deadline: All submissions must be received by 2 November 2024, midnight Central Africa Time (CAT).
- Content Limitations: Submissions must adhere to our Content Limitations policy (see Section 6).
4. Grant of Rights
By submitting your artwork, you:
- License: Grant The Dope Doula an exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your Submission on merchandise and in promotional materials. The artwork will not be licensed to or reused by any other organization, individual, or brand. The Dope Doula may engage third-party service providers (such as printers, designers, and distributors) in the course of producing and promoting the artwork. Necessary alterations may be made to your artwork for formatting, merchandising, or promotional purposes, provided these do not distort the original meaning or message.
- Consent to Use Personal Details: You consent to the use of your name, likeness, and personal details in connection with the promotion of the artwork unless you choose to remain anonymous (see Section 5).
5. Artist Credit and Anonymity
- Credit: The Dope Doula will credit the artist wherever the artwork is used, including on social media pages, the website, and merchandise. Artists may submit an artist profile to be featured along with their artwork.
- Anonymity: If an artist chooses not to be publicly credited due to the sensitive nature of drug use or stigma, they may opt to remain anonymous by notifying us in writing.
- Opting Out of Promotion: Artists who prefer not to have their work featured in promotional materials (e.g., social media, website) may opt-out by notifying us in writing.
6. Content Limitations
Submissions must not contain:
- Stigmatizing Imagery: Content that reinforces negative stereotypes about drug use or individuals who use drugs.
- Hate Speech: Material that promotes hatred or violence against any person or group.
- Derogatory Content: Disrespectful or demeaning material toward any individual or group.
- Illegal Content: Any content that is illegal under applicable laws.
If your submission contains prohibited content, we will notify you and allow you the opportunity to make necessary adjustments.
7. Disqualification
We reserve the right to disqualify any Submission that:
- Violates these Terms and Conditions.
- Contains prohibited content as outlined in Section 6.
- Is received after the submission deadline.
- Is deemed inappropriate or unsuitable at our sole discretion.
Artists who are disqualified will be notified via email.
8. Selection Process
- Notification: Selected artists will be notified via email by 15 November 2024.
- Final Decisions: All selection decisions are final and made at the sole discretion of The Dope Doula.
9. Privacy and Data Protection
Your personal information will be handled in accordance with our Data Protection and Privacy Policy. The Dope Doula may share your personal information with third-party service providers (such as printers, designers, or distributors) only to the extent necessary to facilitate the use of your artwork and ensure its proper display on merchandise or promotional materials. These third-party providers will be bound by confidentiality agreements to protect your data.
10. Limitation of Liability
The Dope Doula, its employees, agents, service providers, and affiliated third parties shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Initiative.

12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of South Africa.

Artist Agreement
This Artist Agreement ("Agreement") is made between you ("Artist") and The Dope Doula ("Organization"), located in Garden Route District, Western Cape, South Africa.
1. Grant of Rights
- License: The Artist grants The Dope Doula an exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the submitted artwork ("Artwork") on merchandise and in promotional materials. This exclusive license ensures that the artwork will not be licensed to or reused by any other organization, individual, or brand. The Dope Doula may engage third-party service providers (such as printers, designers, and distributors) in the course of producing and promoting the artwork, subject to confidentiality obligations.
- Alterations: The Organization may make necessary alterations to the Artwork for formatting, merchandising, or promotional purposes without distorting the original meaning or message.
2. Artist Credit and Anonymity
- Credit: The Organization will credit the Artist whenever the Artwork is used, including on social media, the Organization's website, or any merchandise. Artists may also submit an optional artist profile for use in promotional materials.
- Anonymity: If an Artist prefers not to be publicly credited, they may opt to remain anonymous by notifying the Organization in writing.
3. Ownership
The Artist retains all ownership rights to the Artwork, subject to the exclusive license granted to The Dope Doula.
4. Compensation
Participation in the Initiative is voluntary, and no financial compensation will be provided for the use of the Artwork.
5. Warranties and Representations
- Original Work: The Artist warrants that the Artwork is original and does not infringe upon any third-party rights.
- Consent: The Artist consents to the use of their personal details as provided unless they opt for anonymity.
6. Indemnification
The Artist agrees to indemnify and hold harmless The Dope Doula, its employees, agents, and any third-party service providers (such as printers or designers) involved in the Initiative from any claims, damages, or expenses arising from any breach of this Agreement.
7. Withdrawal
The Artist may withdraw their Submission by providing written notice to the Organization prior to the Artwork being published or produced on merchandise.
8. Governing Law
This Agreement is governed by the laws of the Republic of South Africa.
9. Acknowledgment
By submitting the Artwork, the Artist acknowledges that they have read, understood, and agreed to be bound by this Agreement.
